                               RESOLUTION NO.18889
                   
                   
                   A RESOLUTION ADOPTING AN ENFORCEMENT 
                   RESPONSE PLAN FOR INSTANCES OF NONCOMPLIANCE 
                   BY INDUSTRIAL USERS OF THE SEWER SYSTEM.
                   
                   
                                                     
                   
                   
       	    	 WHEREAS, 40 C.F.R. Part 403.8(f)(5) requires that 
       publically owned treatment works develop and implement an 
       Enforcement Response Plan; and
       	    	 WHEREAS, a public hearing has been held to receive 
       comments and no significant comments have been received in 
       opposition to the proposed Enforcement Response Plan;
       	    	 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 
       THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
       adopted an Enforcement Response Plan, a copy of which is attached 
       hereto and incorporated herein by reference, for instances of 
       noncompliance by industrial users of the sewer system.
